Equal Employment Opportunity (EEO)

The Federal Transit Law, 49 U.S.C. 5332(b) provides that "No person in the United States shall on the grounds of race, color, creed, national origin, sex, age, or disability be excluded from participating in, or denied the benefits of, or be subject to discrimination in employment under any project, program, or activity receiving federal financial assistance." States are responsible for their own compliance and for assuring FTA that all subrecipients are in compliance with EEO objectives in accordance with FTA requirements. A formal Equal Employment Opportunity (EEO) Program is required of any grantee which employs 50 or more transit-related employees (either directly or through contractors) and received in excess of $1,000,000 in capital or operating assistance or in excess of $250,000 in planning assistance during the previous federal fiscal year. Subrecipients that are required to submit an EEO program should submit it to the state rather than directly to FTA or FHWA.
